Preparation, filing and prosecution

Our approach is based on understanding the commercial needs of the client, and drafting a patent specification to meet those needs. We appreciate that each client is different and so we are careful to formulate a filing strategy best suited to that client. This takes into account not only the commercial objectives of the client but also the costs associated with any filing strategy.

This is one reason why we have been successful in guiding so many of our clients from a start-up or spin-out stage to eventual trade sale or IPO.

Post-grant proceedings

We have a significant EPO opposition and appeals practice, with all attorneys regularly handling contentious work at the EPO. We defend and oppose patents on behalf of a number of well-known corporations including Procter & Gamble, Honeywell and Rockwool. As a result, we have extensive experience of the strategic and procedural aspects of these proceedings.

Due diligence and strategy development

We are often involved with clients from an early stage and have considerable experience acting for start-up companies. We also have experience advising investors on IP issues arising from investments at all stages of funding, for whom we provide clear and concise advice and reports as part of the IP due diligence process.

Through our experience with start-ups and spin-outs and our strong connections within the private equity investment community, we have developed expertise in advising clients in dealing with IP due diligence.

We appreciate that preparing for IP due diligence does not begin several weeks before an IPO or trade sale, but must be considered from the very earliest stage of developing an IP portfolio. For this reason we provide early-stage strategic IP management advice so that the client can avoid future pitfalls when an actual due diligence exercise is carried out.

We offer pragmatic advice to companies on the development of cost-effective IP strategies and their role as an important element of any successful business plan. We have assisted many of our clients through several rounds of funding, leading to trade sale or IPO.
