Design
At GJE, we handle all matters relating to design work worldwide, including prosecution, revocation, invalidity and infringement matters.
Design protection exists both as registered and unregistered designs and covers the outward appearance of an article. The scope of protection of a design is considerably narrower than that of a patent, but the cost of obtaining the protection is considerably less. In addition, designs are usually granted within a few months from filing, whereas it takes several years to obtain patent protection.
Design protection is generally useful for products whose appearance is important and should generally be sought only once a design or a group of designs has been finalised as, depending on prior known designs, only slight modifications to a design will take it outside the scope of the design protection.
